McAllen Personal Injury Lawyer

McAllen Personal Injury Lawyer  >  McAllen Personal Injury Lawyer

The adjuster's first call usually lands before your first follow-up appointment. Whatever offer comes with it is priced on the paperwork that exists that day, and almost everything that raises the value of a claim shows up after that.

Ramos James Law represents injured people in McAllen, Edinburg, Pharr, Mission and the rest of the Rio Grande Valley.

Our personal injury attorneys handle the insurance company, the evidence and the deadlines. You can start the whole thing with a phone call, and we answer 24/7, in English or Español.

Call +1 (512) 537-3369 for a free case review.

Can You Handle a McAllen Case From Austin?

Yes. Cases are handled by phone, by video and with documents you sign electronically. We travel to the Valley when a case calls for it. Nobody needs to burn a day of work sitting in a waiting room.

Where a case gets filed depends on Texas venue rules, not on where the lawyer sits. It is often the county where the crash happened, but it can also be the county where the at-fault driver lives or where a defendant company has its main Texas office. Filing deadlines come from Texas state law and are the same whoever ends up handling the case.

What changes from firm to firm is how fast the work starts and who picks up when you call.

Injury Cases We Take in the Valley

We take cases where someone else caused the injury.

Car crashes, commercial truck collisions, pedestrian and bicycle injuries, motorcycle wrecks, dog attacks, falls on someone else's property, head injuries, wrongful death.

Truck cases carry extra weight down here. The Pharr-Reynosa International Bridge is the country's number one crossing for produce, and that freight runs the Expressway 83 and 281 corridors around the clock.

When a commercial rig is involved, the claim can reach the driver, the motor carrier, the company that loaded the trailer, and more than one insurance policy.

We also take workplace injury claims when the employer carries no workers' compensation coverage, which is legal in Texas and more common than people expect. If you are not sure which kind of claim you have, ask us. Our Austin car accident attorneys page explains how those claims work.

What if the other driver was visiting from Mexico?

It happens often near the bridges, and it changes where the money comes from. A Mexican auto policy usually provides no liability coverage for a crash on this side. A rental or a borrowed vehicle may carry coverage of its own.

Your own uninsured motorist coverage can also come into play when the at-fault driver has no policy that answers in Texas. Getting the plate, the license and the insurance card at the scene matters more in these cases than in almost any other.

Where Is an Injury Lawsuit Filed in Hidalgo County?

If the case is filed in Hidalgo County state court, it will most likely be heard at the county courthouse in Edinburg, at 100 N. Closner Blvd. Edinburg is the county seat, so most state civil cases from McAllen, Pharr, Mission and the rest of the county are filed and heard there. Some cases belong in federal court, which sits in McAllen, and some may be filed in another county under Texas venue rules.

Once a case is filed, hearings and deadlines run on the Edinburg court's calendar. We handle that part. You show up only when it counts, for a deposition or a trial setting.

Most claims settle long before that point. A case built as though it will be tried tends to settle better anyway, because the insurer can see what is waiting if it does not.

How Long Do You Have to File a Claim in Texas?

The deadline to sue for a personal injury in Texas is generally 2 years from the date of the accident under Section 16.003 of the Civil Practice and Remedies Code, with exceptions that can shorten or change it.

The exception that costs people their claims involves government vehicles and property.

If a City of McAllen vehicle, a county truck or a school district bus was involved, the Texas Tort Claims Act requires formal written notice far sooner. Six months in many cases, and some cities give you less than that.

A second clock runs faster than the law. Security video from a store or a gas station can be recorded over within days. In a truck case the vehicle's electronic data has its own retention limits, which is why we send preservation letters the week a case comes in.

What If You Were Partly at Fault?

You can still recover as long as your share of the blame is 50 percent or less, and your recovery drops by that percentage. Above 50 percent, Texas proportionate responsibility rules bar recovery entirely.

That rule is why an adjuster asks so many questions that sound routine. Whether you saw the other vehicle. How fast you were going. Whether you had your seatbelt on. Each answer is a chance to move a few percentage points onto you.

Recorded statements taken in that first week, before anyone has even seen the police report, are where those percentages usually get built, one small admission at a time.

Before you give a recorded statement, call +1 (512) 537-3369. The consultation is free.

What an Injury Claim Can Cover

A claim can cover the medical bills you already have, the care your doctors say is still coming, lost wages, and lost earning capacity if you cannot go back to the same work.

Then there is the harm that arrives without a receipt. Texas law calls that physical pain and mental anguish, and measures physical impairment and disfigurement alongside it.

Serious injuries in the Valley often start at DHR Health in Edinburg, the region's first Level I trauma center. Those records and charges anchor the whole claim. They have to be requested in full, not as a discharge summary.

If you have no health insurance, many Valley clinics will treat under a letter of protection, an agreement to be paid out of the recovery at the end of the case. We help clients find that care so treatment doesn't stop while the claim is pending, and we ask how the treatment is going, not only how the claim is going.

The First Few Days After an Accident

See a doctor, even if you think you walked away from it.

Neck, back and head injuries frequently surface a day or two later. A gap between the accident and that first visit is the first thing an insurer points to when it wants to pay less.

Keep everything in one place: the crash report number, photos of the scene and the vehicles, names and numbers of witnesses, medical bills, and a list of the days you missed work. Workers paid in cash can show income with bank deposits, texts confirming jobs, and letters from a contractor.

Say as little as possible to the other driver's insurer to nothing until you have advice. That first call sounds like a formality, and it fixes a version of events that shapes everything after it.

What Happens in the First Week of Your Case

We start with the evidence that disappears.

The crash report, nearby camera footage, witness contact information, and in truck cases a letter putting the carrier on notice to preserve driver logs and electronic data.

Then we look at every source that could pay: the at-fault driver's policy, an employer's policy if that driver was working, the vehicle owner's policy, and your own uninsured motorist coverage, which plenty of people carry without knowing it. The Texas Department of Insurance explains how that coverage works.

You get straight answers while that happens, because integrity is not something we save for the end of a case. Bad news comes in the same plain terms as good news. If we think your claim is worth less than you were hoping, you hear it before you make a decision, not after.

The first week is where the advocacy actually happens, long before anything gets filed, because the proof that decides a case in month ten is the proof somebody saved in week one.

Communities We Serve in the Rio Grande Valley

Beyond McAllen, we take cases from Edinburg, Pharr, Mission, Alamo, San Juan, Weslaco, Donna, Hidalgo, Mercedes, and Rio Grande City. If your accident happened somewhere else in South Texas, call anyway and we will look at it.

The firm works out of Austin, and the same attorneys who handle these cases in Central Texas handle the ones that come from the Valley.

Who Will Handle Your Case?

Ramos James Law recognition for a 2025 Texas personal injury verdict

Laura Ramos James founded the firm and has spent more than 15 years on personal injury cases. She grew up in Mexico. She chose Baylor Law School for its litigation program and started out taking depositions and appearing in court.

Her early years were on the other side, defending insurance companies. The assignment was to prove that injured people were not as hurt as they said.

She switched sides after a case where she was told to show that a grieving widow had moved on with her life, and that was not the truth. It is also why we know the arguments an adjuster will reach for before they arrive.

The firm was built with several attorneys on purpose, and our attorneys, paralegals and assistants speak Español, so no client waits for the one person who translates. Our results include a $1,273,000 jury verdict in a premises liability case against a Hyatt hotel in Dallas, and more are published on our case results page.

Contingency Fees and Free Consultations

Nothing upfront. We take injury cases on contingency, which means our fee comes out of the recovery at the end, there are no fees unless we win, and the first conversation is free either way. If we review your case and believe you do not have a claim worth pursuing, we say so, and that review still costs you nothing.

McAllen Injury Questions We Hear Most

Do I have to come to your office to hire a lawyer?

No. You can hire us over the phone, sign the agreement electronically and handle the whole case without leaving McAllen. We come to the Valley when a case needs an in-person meeting, a site inspection or a court setting.

Will my hospital bills get paid out of my settlement?

That is the goal. Hospitals and health plans can assert liens or reimbursement rights against an injury recovery, and Chapter 55 of the Texas Property Code sets the rules for hospital liens. We identify those claims early and work to reduce them, which leaves more of the settlement with you.

How long does a personal injury case take in the Valley?

A straightforward claim with clear liability can resolve in a few months. Cases involving surgery, disputed fault or a commercial trucking company take longer, since a claim is not ready to value until your doctors know what your long-term condition looks like.

What if the driver who hit me took off?

Report it to the police right away, then check your own policy. Uninsured motorist coverage can pay for a hit-and-run as long as it was reported. We also pull camera footage from nearby businesses fast, because that is usually how an unidentified driver gets found.

Can I still get help if I was hurt on the job?

Yes, especially if your employer does not carry workers' compensation. Texas lets employers opt out, and an employer that opts out is called a non-subscriber. When a non-subscriber's negligence caused your injury, you may be able to bring a claim directly against the company.
